1. Acceptance of Terms

The Site is operated by Equipter, LLC ("Equipter," "we," "us," or "our"), 49 Eagle Drive, Suite 102, Leola, Pennsylvania 17540. By accessing or using the Site, submitting a form, or opting in to our mobile messaging program, you agree to these Terms and to our Privacy Policy, which is incorporated by reference. If you do not agree, please do not use the Site.

2. Eligibility

The Site is intended for users in the United States who are at least 18 years old and able to form legally binding contracts. Equipter products are designed for professional and commercial use.

3. Mobile Messaging (SMS) Terms

Equipter offers an optional mobile messaging program (the "Program") through short code 253034. These Mobile Messaging Terms apply to your participation in the Program.

• Program description: When you opt in, you may receive recurring text messages from Equipter about product information, pricing updates, rental availability, financing offers, and quotes for the Equipter 4000 and related products.
• Opting in is optional: You can opt in by checking the SMS consent box on an Equipter webform, such as our Build & Buy quote form. By leaving this box unchecked, you will not be opted into this short code campaign, and you can still submit the form and receive your quote.
• Not a condition of purchase: Your consent to receive text messages is not a condition of purchasing any goods or services.
• Message frequency: Message frequency varies.
• Costs: Message and data rates may apply. Contact your wireless provider for details about your plan.
• How to opt out: Text STOP to 253034 at any time to cancel. You will receive one final message confirming that you have been unsubscribed, and no further messages will be sent unless you opt in again. You may also reply END, CANCEL, UNSUBSCRIBE, or QUIT.
• How to get help: Text HELP to 253034, email info@equipter.com, or call 717-661-3591.
• Carrier liability: Wireless carriers are not liable for delayed or undelivered messages.
• Changing your number: If you change or deactivate your mobile number, please text STOP from that number first so messages are not sent to the number's next owner.
• Privacy: We do not sell, rent, or share your mobile number or SMS opt-in data with third parties for their own marketing purposes. See our Privacy Policy for details.

4. Quotes, Pricing, and Availability

Prices, specifications, promotions, and availability shown on the Site or in quotes are subject to change without notice. Quotes generated through the Site are estimates only and are not a binding offer to sell. A sale is final only when confirmed in a written purchase agreement or invoice issued by Equipter. We reserve the right to correct pricing or typographical errors and to refuse or cancel any order.

5. Purchases, Delivery, and Warranty

Each purchase of an Equipter product is governed by the purchase agreement, invoice, and written limited warranty provided with that product, which control over any conflicting statement on the Site. Delivery dates are estimates and are not guaranteed. Warranty coverage is limited to the terms of the written Equipter warranty for your product.

6. Rentals

Equipment rentals are subject to a separate rental agreement, which governs rates, deposits, insurance, damage, and return requirements. Rental availability shown on the Site is not a reservation until confirmed by Equipter.

7. Financing

Equipter is not a lender and does not provide financing. Financing inquiries submitted through the Site are governed by our separate Financing Terms and Conditions.

8. Safe Operation

Equipter products are heavy equipment and must be operated only by trained, qualified operators in accordance with the operator's manual, safety decals, and all applicable laws and regulations. Videos, articles, and tutorials on the Site are for general information only and do not replace the operator's manual or proper training.

9. Use of the Site

You agree to use the Site only for lawful purposes. You may not submit false or misleading information, impersonate any person or business, use automated tools to scrape or collect data from the Site, attempt to gain unauthorized access to the Site or its systems, or interfere with the Site's operation or security.

10. Intellectual Property

All content on the Site, including text, images, videos, graphics, and software, and the EQUIPTER name, logos, and product names, are owned by Equipter or its licensors and are protected by intellectual property laws. You may not copy, reproduce, modify, or distribute Site content without our prior written permission, except for viewing and personal, non-commercial use.

11. Submissions and Reviews

If you submit feedback, reviews, testimonials, photos, or other content to Equipter, you grant Equipter a non-exclusive, royalty-free, perpetual license to use, reproduce, and display that content in connection with our business and marketing. You confirm that you have the right to share anything you submit.

12. Third-Party Sites and Services

The Site may link to websites and services operated by third parties, including our online service and parts store and third-party financing partners. Equipter is not responsible for the content, terms, or privacy practices of third-party sites, and your use of them is at your own risk.

13. Affiliate Program

Participation in the Equipter affiliate and referral program is governed by our separate Affiliate Terms and Conditions.

14. Disclaimer of Warranties

THE SITE AND ITS CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Equipter does not guarantee that the Site will be uninterrupted, error-free, or free of harmful components. This section does not affect the written limited warranty provided with any Equipter product.

15. Limitation of Liability

To the fullest extent permitted by law, Equipter and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising from your use of the Site or the Program. Equipter's total liability for any claim arising from your use of the Site will not exceed one hundred dollars ($100). Liability relating to products you purchase is governed by your purchase agreement and product warranty.

16. Indemnification

You agree to indemnify and hold harmless Equipter and its officers, employees, and agents from any claims, losses, or expenses, including reasonable attorneys' fees, arising from your misuse of the Site or your violation of these Terms.

17. Governing Law

These Terms are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-law rules. Any dispute arising from these Terms or your use of the Site will be brought exclusively in the state or federal courts located in Lancaster County, Pennsylvania, and you consent to the jurisdiction of those courts.

18. Changes and General Terms

We may update these Terms at any time by posting a revised version on this page. Your continued use of the Site or the Program after changes are posted means you accept the updated Terms. If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce any provision is not a waiver of our right to do so later.

19. Acceptance

By checking a consent box and clicking "Submit" (or a similar button) on any Equipter form, you acknowledge that you have read, understood, and agree to be bound by these Terms.
